An Abuja court has fined Busola Dakolo N1 million after dismissing her rape case against COZA's Pastor Biodun Fatoyinbo.
Some months ago, Busola, wife of singer Timi Dakolo, had accused the pastor of rape some years ago before she got married. She had demanded "a personal letter of apology to show remorse for his misdeeds.
She made this allegation in a video with Chude Jideonwu of Red Africa Media.
The judge, Justice Oathman A. Musa, said that the matter amounts to injustice and an abuse of judicial process adding that the case is empty and purely sentimental. He also said that the case was aimed more at cruelty than obtaining justice.
In awarding the cost of N1 million against Busola Dakolo, the court held that the fine should have been 10 times more because the court’s time was wasted.
Fatoyinbo’s team of lawyers, led by Dr. Alex Izinyon (SAN), had however argued that the prayers in the suit were ungrantable by the court, and that the suit was frivolous and an abuse of court process.
